Chester County Quick Facts
Chester County Clerk of Court Records
The Chester County Clerk of Court website is at chestercountysc.gov. The Clerk's office is located in Chester, the county seat. It maintains all official court records for Chester County including General Sessions criminal files, Common Pleas civil records, and Family Court documents.
Criminal records at the Clerk's office include warrants, indictments, bond documents, sentencing sheets, and complete case files. You can visit in person during business hours or submit written requests for copies. The Clerk's website has current contact information including phone, address, and hours.
Standard copy fees in South Carolina courts are typically $0.25 per page. Certified copies carry additional fees. Payments are usually accepted in cash, check, money order, or credit card, but confirm with the office.
Note: Case files that have been archived may take longer to retrieve. Calling ahead and providing a case number or approximate filing year can speed up the request.
Chester County Public Index Online Search
The Chester County Public Index provides free online access to court records. It is maintained by the SC Judicial Branch and is available at all hours. Search by party name, case number, or date range.
The system shows case status, charges, hearing dates, docket entries, and judge assignments. Real documents are not downloadable. For certified copies, contact the Clerk. Juvenile records are not accessible through the public system.
New filings may take a short time to appear after entry. The most efficient searches use a full name paired with a date of birth or approximate case year to reduce unrelated results in a common-name search.
Note: The Public Index includes both criminal and civil case types, so filter by case type if you want to focus specifically on General Sessions criminal matters.
Chester County Criminal Court Process
Chester County General Sessions Court handles felonies and serious misdemeanor cases. Cases come from arrest, indictment, or direct information filing. They move through arraignment, hearings, and trial or plea before a final disposition is entered.
Magistrate courts in Chester County handle lower-level offenses, traffic violations, bond hearings, and small civil claims. These cases may appear in the Public Index, but some may require direct contact with the local magistrate office for records. The SC Judicial Branch courthouse directory at sccourts.org lists addresses for Chester County courts.
The Municipal Court in the City of Chester handles violations of city ordinances. Records from the municipal court are separate from General Sessions records and would require a direct request to the city.
Note: When someone has both magistrate-level and General Sessions records in Chester County, both sources may be needed to build a complete picture of their criminal history.
SLED Criminal History Check for Chester County
SLED maintains South Carolina's central criminal history repository. A SLED search covers all 46 counties including Chester. This is the most thorough way to search criminal history at the state level without manually checking each county.
The SLED CATCH system charges $25 for a name-based online check. Fingerprint-based requests are more accurate and can be submitted by mail to SLED Records, PO Box 21398, Columbia SC 29221, or by calling 803.896.1443. Fingerprint checks are not subject to name-match errors.
The main SLED website explains the criminal history program and what records are maintained. The governing statute is at Title 23, Chapter 3 of the South Carolina Code.
Note: A SLED check returns South Carolina history only. Federal charges and out-of-state convictions require separate searches through those jurisdictions.
Chester County Arrest Records and Sheriff
The Chester County Sheriff's Office provides law enforcement to unincorporated parts of the county. Arrest records, incident reports, and booking information are held by the Sheriff. Requests for these records should be made under the South Carolina Freedom of Information Act at Title 30, Chapter 4.
Arrest records and court records are distinct. An arrest record shows who was taken into custody. Court records from the Clerk of Court show what happened after arrest. Both can be useful when researching Chester County criminal history. The two systems are maintained separately and must be checked independently.
Note: FOIA responses for records under two years old must come within 10 business days. Records older than two years have a 20-day response window under South Carolina law.
SC Corrections and Probation Records
People convicted in Chester County and sentenced to state prison can be found through the SC Department of Corrections inmate search. The free tool shows current incarceration, sentence length, and release data. Search by name or SC DOC identification number.
The SC Department of Probation, Parole and Pardon Services supervises people on active probation or parole in Chester County. They also process pardon applications. Expungement under Section 17-1-40 can permanently remove eligible records from public access.
Note: A pardon and an expungement are separate outcomes with different legal effects. Only certain conviction types qualify for expungement under South Carolina law.
Sex Offender Registry and Additional Resources
The South Carolina Sex Offender Registry at scor.sled.sc.gov can be filtered by county to show registered offenders in Chester County. The registry is free, public, and maintained by SLED.
The SC Attorney General's office maintains opinions on expungement and pardon law at scag.gov. These can be useful for understanding how South Carolina courts have interpreted criminal history statutes over time.
Note: The sex offender registry is updated regularly, but address changes may not appear immediately after a registrant moves.
