Marion County Clerk of Court

The Marion County Clerk of Court is the Honorable Christy M. Gray, who was elected November 8, 2016, and began service January 3, 2017. Born in Mullins, SC, she attended Florence-Darlington Technical College, Francis Marion University, and Limestone College. Clerk Gray worked with the Marion County Sheriff's Department from 1991-92 and with the Marion County Clerk of Court Family Court Division from 1992-95. She returned to the Clerk's office in 2011 in the General Sessions Division before her election.

Marion County Criminal History via the Public Index

The Marion County Public Index is hosted by the SC Judicial Branch and available around the clock. No account is needed. Search by defendant name, by case number, or by date range. Select the case type you want: Criminal, Civil, or Family.

Each record shows the case number, filing date, defendant name, charges, scheduled court dates, case status, and attorney information. That gives you enough to confirm whether a case was filed and what the outcome was. Actual court documents are not downloadable online. Visit the Clerk's office on North Main Street for filings, orders, and certified copies.

Juvenile records, sealed cases, and expunged matters do not appear in the system. A recent arrest may not show up for several business days. The Public Index is a useful starting point for Marion County criminal history research but does not replace a direct courthouse visit or a SLED check.

Marion County Sheriff and Arrest Records

The Marion County Sheriff is J. Brian Wallace, who began with the department in 1999 as a road deputy. He moved to the Criminal Investigations Division and then, in 2005, joined the Marion County Combined Drug Unit, becoming its director in 2007. The Detention Center is at a separate location: 2715 E. Highway 76, Mullins, SC 29574. It houses inmates awaiting trial and those serving shorter sentences. Visitation policies are available through the main office.

Records held by the Sheriff include incident reports, accident reports, arrest records, booking information, and limited warrant information. To request records, visit the office in person, present valid photo ID, provide specific details about the incident, and pay the applicable fees. Allow processing time for the report to be compiled.

Marion County Records Law and Expungement

South Carolina's Freedom of Information Act at Title 30, Chapter 4 gives the public the right to inspect most government records. Written requests must be submitted. Agencies have 10 business days to respond for records under 24 months old and 20 days for older files. Fees reflect actual reproduction costs.

Under Section 23-3-115, SLED is the state's central criminal records authority. The Clerk of Court is required under Section 23-3-120 to report case dispositions to SLED within set timeframes so Marion County records stay current in the statewide database.

Expungements follow Section 17-1-40. A completed expungement removes the record from the Public Index, from SLED, and from the Clerk's office files. The 12th Circuit Solicitor reviews and approves petitions. The Clerk handles record destruction after the judge signs the order. The process can take several months. Violent felonies and most serious offenses cannot be expunged under current South Carolina law.
