Oconee Public Index Online Search

The Oconee County Public Index is a free online tool provided by the SC Judicial Branch. You can search General Sessions criminal cases using a last name and first name or a case number in the YYYY-GS-XX-XXXX format. Results show the defendant's name, charges with statute citations, court dates, attorney of record, judge assignment, bond amount, and the final disposition of the case.

The Public Index is updated daily. It is not a real-time feed, so very recent activity may not appear immediately. Expunged and sealed records are excluded from the display. Juvenile records are never shown. When you need a certified copy of a document shown in the Public Index, you must visit the Clerk's office in person. The online system only shows index data, not the actual court documents themselves.

Note: Searching the Public Index is free, but it does not replace a formal criminal background check run through SLED.

SLED Criminal Background Check for Oconee County

The South Carolina Law Enforcement Division maintains the statewide criminal history repository. A SLED background check covers Oconee County arrests and convictions along with all other South Carolina counties in a single search. This is the most thorough way to run a criminal history check for anyone who has lived in multiple counties across the state.

SLED offers a name-based criminal history search through the SLED CATCH system at catch.sled.sc.gov. The fee is $25 per search plus a $1 online convenience fee. Payment is accepted by credit or debit card. Results are provided immediately after payment. The search is name-based, which means it may return records for people with the same name, so review results carefully to confirm the identity of the person you are researching.

SLED also maintains the South Carolina Sex Offender Registry (SORT). This registry is free to search and includes registrants from every county, including Oconee. You can also contact the SLED Public Dissemination Unit by phone at 803.896.1443, Monday through Friday from 9 a.m. to 4:30 p.m., if you have questions about a criminal history record. Note that SLED has been closed to in-person visits since December 15, 2008.

Under SC Code Section 23-3-115, SLED is authorized to disseminate criminal history records to the public through the CATCH system. The law sets out what information is included in a public criminal history record and establishes that certain dispositions, such as charges dismissed after a PTI program, may not appear in the standard public search.

Public Records Law and Oconee County FOIA

South Carolina's Freedom of Information Act is codified at SC Code Section 30-4-30. This law gives the public the right to inspect and copy records held by state and local government agencies in Oconee County, including law enforcement records that are not otherwise restricted. Written FOIA requests should be submitted to the specific agency that holds the records you want.

For Oconee County law enforcement records, direct your request to the Sheriff's Office at 300 S. Church Street, Walhalla, SC 29691. For court records, contact the Clerk of Court. The agency has 10 business days to respond to a FOIA request for records less than 24 months old and 20 business days for older records. Documents must be produced within 30 calendar days of a final determination. Copy fees are $0.25 per page, and search and retrieval costs are based on the actual time of the lowest-paid employee capable of performing the search.

Open criminal investigation records are generally exempt from FOIA disclosure. Court records that are sealed or expunged are also not subject to public inspection. All other finalized criminal case records are public records accessible under state law.

Oconee County Expungement Process

Expungement removes a criminal record from public view. In South Carolina, the expungement process is governed by SC Code Section 17-1-40. When a record is expunged, it is no longer visible in the Public Index, and SLED removes it from the criminal history database. The Clerk of Court in Oconee County processes expungement orders issued by the circuit court.

Eligibility for expungement depends on the type of charge and the outcome of the case. Charges that were dismissed, charges that resulted in a verdict of not guilty, and certain first-offense convictions may be eligible. The Solicitor's Office for the 10th Judicial Circuit reviews and approves or denies expungement petitions before they go to a judge. Processing times vary, but most expungements take several months from filing to completion.

After an expungement order is signed, the Clerk sends copies to SLED and other relevant agencies. The record is then removed from the Public Index and the SLED criminal history database. The SC Judicial Branch provides general information about the expungement process online. For specific eligibility questions, speaking with an attorney familiar with 10th Circuit practice is advisable.
